1. Acceptance of Terms

By downloading, installing, or using DomainWill ("the Software"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Software.

2. License

DomainWill grants you a non-exclusive, non-transferable license to use the Software on your personal devices. The Free tier permits use with up to 25 domains. The Pro tier ($99 one-time payment) permits unlimited domains and access to all features.

Inherited vaults: If you receive a DomainWill vault file through the Dead Man's Switch, inheritance, or direct transfer from a licensed Pro user, you are granted full access to the Software at no additional cost for the purpose of managing that inherited portfolio.

3. Not Legal, Financial, or Estate Planning Advice

⚠️ DomainWill is a portfolio organization and information management tool. It is NOT a substitute for professional legal, financial, or estate planning advice. You should consult a qualified attorney for estate planning, asset protection, and inheritance matters specific to your jurisdiction and circumstances.

4. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

The Software will meet your specific requirements
The Software will be uninterrupted, timely, secure, or error-free
The Dead Man's Switch feature will successfully deliver notifications under all circumstances
Encrypted data will be recoverable if you lose both your master password and recovery phrase
Any information stored in the Software (including domain valuations, registrar procedures, or recovery instructions) is accurate, complete, or current

5. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE AUTHORS, COPYRIGHT HOLDERS, OR DISTRIBUTORS OF DOMAINWILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of domains due to expired registrations
Loss of revenue or anticipated profits from domain sales
Loss of data or credentials
Failure of the Dead Man's Switch to activate or deliver notifications
Unauthorized access to your vault due to compromised passwords
Any actions taken by heirs or beneficiaries based on information in the Software

IN NO EVENT SHALL THE AUTHORS, COPYRIGHT HOLDERS, OR DISTRIBUTORS OF DOMAINWILL HAVE ANY LIABILITY TO YOU FOR ANY CLAIMS, DAMAGES, OR LOSSES ARISING FROM YOUR USE OF THE SOFTWARE. YOUR USE OF THE SOFTWARE IS ENTIRELY AT YOUR OWN RISK.

6. Your Responsibilities

You are solely responsible for:

Maintaining the security of your master password and recovery phrase
The accuracy of information you enter into the Software
Ensuring your heirs or beneficiaries can access your vault credentials when needed
Regularly backing up your vault file
Keeping your domain registrations current and paid
Consulting appropriate legal professionals for estate planning

7. Encryption and Data Loss

DomainWill uses AES-256 encryption. If you lose both your master password and your recovery phrase, your vault data is permanently and irretrievably lost. We cannot recover your data under any circumstances. This is by design for your security.

8. Dead Man's Switch

The Dead Man's Switch feature is a convenience tool that attempts to send email notifications when you fail to check in within a specified period. It requires a working SMTP email configuration, internet connectivity, and the application to be running. We do not guarantee delivery of notifications and this feature should not be relied upon as your sole inheritance plan.

9. Refunds

Pro license purchases are non-refundable after 30 days. Within 30 days of purchase, you may request a full refund by contacting us.

10. Modifications

We reserve the right to modify these terms at any time. Continued use of the Software after changes constitutes acceptance of the revised terms.

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Tennessee, United States, without regard to conflict of law provisions.
